| Sonic 2009-05-25 10:36:29 | ALAE head office may well be able to give you the correct gen if you ask them directly. This question has probably been asked many times already. My understanding is that if bonding arrangements are written into your contract then you're stuck with it, if they are not written into your contract then you should be able to contest it. You say that the bonding has been "imposed" - this implies it is not in your contract or employment agreement and therefore could be contested. However, did the company make you / anybody sign a bond agreement before starting the course (e.g. sign this or you don't get the training)? Did your union or other representative body agree to this on your behalf? If the employer pushes ahead with this regardless of legality they can make things very difficult for you in the short to medium term. e.g. - 1. You give notice to leave, say one month, and expect to have a full month's pay as your final pay packet only to find it is zero as they have retained the money to pay off your bond. 2. You drop the job and leave with no notice to avoid the above situation but you need your previous employer to confirm your employment history for an airside pass application. Strangley the forms always get lost when they are sent to your previous employer for sign-off. You now lose that new job as it is a requirement that you work airside. They are loads of ways for the employer to screw you over and you could / would get them all over turned going through tribunals and the courts but in the meantime you can't work airside, etc. Fight it now. Get it in writing. Use the ALAE legal services. |
